NZYF: Membership Conditions
By signing up as a New Zealand Young Farmers (NZYF) Member, you acknowledge and agree to the following conditions, which align with the NZYF Constitution.
We reserve the right to amend all or any part of these Terms at any time. Revised Terms will be posted on the NZYF website and Membership Platform and will be effective immediately unless otherwise stated. By registering as a new member or not taking steps to terminate your membership after any amendment takes effect, you agree to be bound by and comply with the Terms as amended. If you do not agree to any amendment, you may contact membership@youngfarmers.co.nz to terminate your membership.
General
- In the conditions, ‘you’ means the person named in the membership registration form, ‘club’ and ‘your club’ refers to the NZYF club that is listed in your member profile in our Customer Relationship Management System (CRM), HubSpot.
Member Contact Information
- You acknowledge that the details you have submitted as part of the registration process are true and correct. If they change, you acknowledge that you are required to notify NZYF membership@youngfarmers.co.nz as soon as possible after they occur or update your profile in the NZYF Member’s Portal.
Eligibility
- To become a member, you must register online through www.youngfarmers.co.nz and pay the membership fee outlined at the time of registering.
- You must be between 15 – 30 years of age as outlined in clause 6.2 of the NZYF Constitution.
- If you ‘age out’ during your membership period, your membership is valid until the 31 December of the year of your 31st birthday.
- The membership period is 12 months and commences from the membership start date until the renewal date.
- Under clause 6.4 of the NZYF Constitution;
- You must not be currently suspended or expelled from NZYF.
- A membership may be declined at the discretion of the NZYF Board if it is suspected that a potential member has acted in a manner that would be cause for suspension of an existing member.
- Your membership is personal to you, and it is not transferable to another person.
- Each member may belong to only one NZYF club at a time and will have full membership rights in that club only.
NZYF Code of Conduct
- You agree to adhere to the NZYF Member Code of Conduct, which you can view in full here.
- If you breach the NZYF code of conduct, you may have your membership suspended, or expulsion as per 15.0 of the NZYF Constitution.
Transferring Clubs
- You can transfer your membership from one club to another at any time during your membership period provided that you notify NZYF: membership@youngfarmers.co.nz
Refunds, Cancelling and Suspension of Membership
- You can cancel your membership at any time by notifying memberships@youngfarmers.co.nz
- As outlined in 6.9 of the NZYF Constitution, NZYF is under no obligation to provide a refund following your resignation or suspension of membership (for whatever reason).
- If NZYF considers, in their discretion, that you have committed a breach of the terms of this Agreement NZYF may have your membership suspended as per 15.0 of the NZYF Constitution.
Acts of God and Unforeseen Circumstances
- If your club is unable to meet for a period due to Acts of God or any unforeseeable circumstance, which is beyond the control of NZYF and/or your club, you will have your membership placed on hold or where possible your membership will be transferred to the nearest club.
Club Winding Up/In Recess
- If during your membership period your club is wound up (closed), you will be transferred to the nearest club or if not applicable, then upon request by you by emailing membership@youngfarmers.co.nz a refund proportional to the period by which you were a member will be given.
Liability
- No withstanding anything in these terms, NZYF will never be liable in connection with any supply of goods or service for any:
- Loss whatsoever, including loss of income, profits, savings or goodwill or for any indirect consequential loss or special exemplary damages; or
- Amount exceeding the purchase price for defective goods;
- Amount not claimed within seven days of the liability arising. Any amount which is claimed within seven days will be subject to NZYF’s reasonable approval.
Consumers Guarantee Act
- Where you are acquiring goods and/or services in trade, the Consumer Guarantees Act 1993 (CGA) will not apply. If the CGA applies, these terms are subject to your rights under the CGA. For the avoidance of doubt, where the CGA applies, its application is limited to the warranties provided for under the CGA.
Health & Safety
- When you attend an official NZYF, club, regional or district event and/or activity you must comply with any reasonable instructions, policies and procedures relating to health and safety that have been notified to you. You should also take reasonable care for your own health and safety and ensure your acts or omissions do not adversely affect the health and safety of others.
- As outlined in the NZYF Drug and Alcohol Policy, if it is proven that you are taking drugs or repeatedly overindulging in alcohol and/or engaging in inappropriate behaviour due to drugs or overindulging in alcohol, this may lead to a disciplinary process being implemented as outlined in 15.0 of the NZYF Constitution.
